General terms and conditions of sale

Article 1: Preamble
The processing of any order implies acceptance of these general conditions. Any changes to these terms and conditions must be approved in writing by us.

Article 2: Price
The prices are those in force on the date of the order, they are in euros TTC.

Article 3: Time limit
Delivery times are given as an indication, any delays do not entitle the purchaser to cancel his order, refuse the goods or claim damages. The company is released from the obligation of delivery for all fortuitous events and or force majeure.

Article 4: Rules
Our sales are for cash payment at the time of ordering. Payments are made by credit card (secure online payment), or by check payable to Les Jardins d'Héméra. In the context of sales to CHR professionals, additional payment periods may be granted In the event of non-payment on the due date, late payment interest may be applied. The company reserves the right to cancel an order, in case of error on the price displayed or unavailability of the product.

Article 5: Transport
The goods, outdoor furniture and accessories, travel at the risk and peril of the recipient, regardless of the client, including when they are shipped carriage paid. It is up to the recipient, in the presence of the deliverer, to note the delays, the damage of the products, their number. In case of reservation and in accordance with articles 105 and following of the Commercial Code, it is up to the recipients to exercise their recourse against the carriers, within the legal terms and deadlines and to inform the company immediately.

Article 6: Return of goods
Pursuant to the provisions of Article L.121-16 of the Consumer Code, the buyer has a period of seven clear days from delivery to return the product delivered for exchange or refund, without penalties, with the exception of return costs. Any postage due will be refused. No returns will be accepted without prior agreement. The goods must be returned in their original packaging.

Article 7: Retention of title (law of 12/05/80)
The goods sold remain our property until full payment of its price. However, the risks relating to said goods are transferred to the buyer as soon as the goods are handed over to the carrier.

Article 8: Disputes
In the absence of an amicable agreement on any disputes, they fall exclusively within the jurisdiction of the commercial court of our registered office.

Article 9: Delivery
Products are delivered unassembled.

Article 10: Warranty
The products are guaranteed for one year against any manufacturing defect regardless of the application of the legal guarantee against hidden defects provided for in Article 1641 of the Civil Code and within the limits that appropriate care must be taken during storage and subject to normal use and maintenance. Metal parts, with the exception of assembly screws, are protected by epoxy resin or paint For hell products, the warranty does not cover scratches and in general, normal wear and tear. It also does not cover any defect resulting from poor maintenance or abnormal use of the product. The deterioration of the coating, as well as any traces of corrosion on the feet that may result from friction on the ground, are not covered: we recommend, depending on the nature of the floor, the use of protective pads available as accessories.

Article 11: use of personal information
Pursuant to Article 27 of Law No. 78-17 of 6 January 1978, relating to data processing, files and freedoms, the information provided may give rise to the exercise of the right of access to the Jardins d'Héméra.
